End User License Agreement (EULA) for ServAlarm

PLEASE READ THIS END USER LICENSE AGREEMENT CAREFULLY BEFORE USING THE SERVALARM APP ("THE APP"). BY DOWNLOADING, INSTALLING, OR USING THE APP, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS EULA. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT DOWNLOAD, INSTALL, OR USE THE APP.

1. Grant of License: Subject to the terms and conditions of this EULA, the developer of ServAlarm ("the Developer") grants you a limited, non-exclusive, non-transferable license to download, install, and use the App on your iPhone for personal, non-commercial purposes.

2. Usage Restrictions: You shall not, and shall not allow any third party to: a) Modify, adapt, translate, reverse engineer, decompile, or disassemble the App, except as expressly permitted by applicable law; b) Remove, alter, or obscure any copyright, trademark, or proprietary rights notices contained within the App; c) Use the App for any illegal or unauthorized purpose or in a manner that violates any applicable laws or regulations; d) Distribute, sublicense, or transfer the App or make it available over a network where it could be used by multiple devices or users without prior written consent from the Developer.

3. Intellectual Property: The App and all content, trademarks, logos, and graphics associated with it are the property of the Developer and protected by copyright, trademark, and other intellectual property laws. This EULA does not grant you any rights to use the Developer's trademarks, logos, or other proprietary rights.

4. User Obligations: You agree to use the App in compliance with all applicable laws and regulations. You shall not use the App to transmit or distribute any harmful or malicious content, engage in any fraudulent activities, or interfere with the proper functioning of the App or its servers.

5. Privacy and Data Collection: The App may collect certain personal information or user data. By using the App, you consent to the collection, storage, and processing of such information in accordance with the Developer's Privacy Policy, which can be accessed within the App or on the Developer's website.

6. Disclaimers and Limitations of Liability: THE APP IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE USE OF THE APP.

7. Termination: This EULA is effective until terminated. The Developer may terminate this license at any time if you fail to comply with the terms and conditions herein. Upon termination, you must cease all use of the App and uninstall it from your iPhone.

8. App Store Provider: You acknowledge that Apple Inc., as the provider of the App Store, is not responsible for the App and its content. Any claims, losses, liabilities, or damages arising from the use or inability to use the App shall be solely handled between you and the Developer.

9. Governing Law: This EULA shall be governed by and construed in accordance with the laws of the jurisdiction where the Developer is located, without regard to its conflict of laws principles.

10. Entire Agreement: This EULA constitutes the entire agreement between you and the Developer regarding the App and supersedes any prior or contemporaneous agreements, communications, or representations.

By downloading, installing, or using the ServAlarm App, you acknowledge that you have read and understood this EULA and agree to be bound by its terms and conditions.

Contrato de Licencia de Usuario Final (CLUF) para ServAlarm

POR FAVOR, LEA ESTE CONTRATO DE LICENCIA DE USUARIO FINAL DETENIDAMENTE ANTES DE UTILIZAR LA APLICACIÓN SERVALARM ("LA APLICACIÓN"). AL DESCARGAR, INSTALAR O UTILIZAR LA APLICACIÓN, USTED ACEPTA ESTAR SUJETO A LOS TÉRMINOS Y CONDICIONES DE ESTE CLUF. SI NO ACEPTA ESTOS TÉRMINOS, NO DESCARGUE, INSTALE O UTILICE LA APLICACIÓN.

1. Concesión de Licencia: Sujeto a los términos y condiciones de este CLUF, el desarrollador de ServAlarm ("el Desarrollador") le otorga una licencia limitada, no exclusiva y no transferible para descargar, instalar y utilizar la Aplicación en su iPhone con fines personales y no comerciales.

2. Restricciones de Uso: Usted no podrá, ni permitirá a terceros: a) Modificar, adaptar, traducir, descompilar, desensamblar o realizar ingeniería inversa en la Aplicación, excepto según lo permitido expresamente por la ley aplicable. b) Eliminar, alterar u ocultar cualquier aviso de derechos de autor, marca registrada u otros derechos de propiedad contenidos dentro de la Aplicación. c) Utilizar la Aplicación para cualquier propósito ilegal o no autorizado, o de una manera que viole cualquier ley o regulación aplicable. d) Distribuir, sublicenciar o transferir la Aplicación o ponerla a disposición en una red donde pueda ser utilizada por múltiples dispositivos o usuarios sin el consentimiento previo por escrito del Desarrollador.

3. Propiedad Intelectual: La Aplicación y todo el contenido, marcas comerciales, logotipos y gráficos asociados son propiedad del Desarrollador y están protegidos por leyes de derechos de autor, marcas comerciales y otras leyes de propiedad intelectual. Este CLUF no le otorga ningún derecho para utilizar las marcas comerciales, logotipos u otros derechos de propiedad del Desarrollador.

4. Obligaciones del Usuario: Usted se compromete a utilizar la Aplicación de conformidad con todas las leyes y regulaciones aplicables. No utilizará la Aplicación para transmitir o distribuir ningún contenido perjudicial o malicioso, participar en actividades fraudulentas o interferir en el funcionamiento adecuado de la Aplicación o sus servidores.

5. Privacidad y Recopilación de Datos: La Aplicación puede recopilar cierta información personal o datos del usuario. Al utilizar la Aplicación, usted acepta la recopilación, almacenamiento y procesamiento de dicha información de acuerdo con la Política de Privacidad del Desarrollador, a la cual se puede acceder dentro de la Aplicación o en el sitio web del Desarrollador.

6. Renuncias y Limitaciones de Responsabilidad: LA APLICACIÓN SE PROPORCIONA "TAL CUAL" SIN NINGUNA GARANTÍA DE NINGÚN TIPO, YA SEA EXPRESA O IMPLÍCITA. EN LA MEDIDA MÁXIMA PERMITIDA POR LA LEY APLICABLE, EL DESARROLLADOR RENUNCIA A TODAS LAS GARANTÍAS, INCLUIDAS, PERO NO LIMITADAS A, LAS GARANTÍAS DE COMERCIABILIDAD, IDONEIDAD PARA UN PROPÓSITO PARTICULAR Y NO INFRACCIÓN. EL DESARROLLADOR NO SERÁ RESPONSABLE DE NINGÚN DAÑO INDIRECTO, INCIDENTAL, ESPECIAL, CONSECUENTE O PUNITIVO QUE SURJA O ESTÉ RELACIONADO CON EL USO DE LA APLICACIÓN.

7. Terminación: Este CLUF es efectivo hasta su terminación. El Desarrollador puede terminar esta licencia en cualquier momento si usted no cumple con los términos y condiciones aquí establecidos. Al finalizar, deberá cesar todo uso de la Aplicación y desinstalarla de su iPhone.

8. Proveedor de la Tienda de Aplicaciones: Usted reconoce que Apple Inc., como proveedor de la App Store, no es responsable de la Aplicación y su contenido. Cualquier reclamo, pérdida, responsabilidad o daño que surja del uso o la imposibilidad de usar la Aplicación será manejado únicamente entre usted y el Desarrollador.

9. Ley Aplicable: Este CLUF se regirá e interpretará de acuerdo con las leyes de la jurisdicción donde se encuentre el Desarrollador, sin tener en cuenta sus principios de conflicto de leyes.

10. Acuerdo Completo: Este CLUF constituye el acuerdo completo entre usted y el Desarrollador con respecto a la Aplicación y reemplaza cualquier acuerdo, comunicación o representación previa o contemporánea.

Al descargar, instalar o utilizar la Aplicación ServAlarm, usted reconoce que ha leído y comprendido este CLUF y acepta estar sujeto a sus términos y condiciones.
